Somali-born Democratic Congresswoman Ilhan Omar is facing a federal criminal investigation linked to her immigration paperwork after US agents searched her Washington, D.C., home on October 12. The operation has intensified a political dispute between Omar and President Donald Trump’s administration, with the Minnesota representative accusing the president of using federal law enforcement to target political opponents.

The US Department of Justice confirmed that agents from Homeland Security Investigations, the investigative arm of the Department of Homeland Security, executed a court-authorised search warrant as part of an ongoing criminal investigation. Authorities have not publicly disclosed the full details of the inquiry or specified what evidence investigators were seeking. Reports citing people familiar with the matter indicate that the investigation concerns alleged immigration fraud and includes paperwork completed by Omar’s late father when she was a child. However, the precise allegations and the evidence supporting them have not been made public.

Omar responded forcefully to the search, describing it as an attempt to intimidate her and undermine her political work. In a statement posted on social media, she accused Trump of targeting her with what she called years of baseless allegations and political attacks. She said the search was the latest escalation in what she described as a campaign of political intimidation, adding, “I will not be silenced.” Her office also condemned the operation, maintaining that she had done nothing wrong and accusing the administration of weaponising federal law enforcement against its political opponents.

The investigation follows years of allegations from Republican politicians and conservative commentators about Omar’s immigration history and previous marriage. Among the claims repeatedly circulated by her political opponents is an allegation that she married her brother to help him obtain immigration benefits. Omar has consistently denied the accusations. Although the claims have remained a source of political controversy, the latest search does not establish that they are true or confirm that they form the basis of the current investigation. Federal authorities have yet to publicly explain the specific conduct they are examining.

Omar’s background has made the case particularly sensitive. Born in Somalia, she fled the country’s civil war with her family and spent time in a refugee camp in Kenya before resettling in the United States. She became a US citizen in 2000 and was elected to Congress in 2018, representing Minnesota’s Fifth Congressional District, which includes Minneapolis. She became the first Somali-American elected to the US Congress and one of the first two Muslim-American women to serve in the House of Representatives.

Since entering Congress, Omar has become a prominent progressive Democrat and a vocal critic of Trump’s immigration policies. Her opposition to the administration’s approach to immigration enforcement has frequently placed her at odds with Republican lawmakers. Trump has also repeatedly criticised her background and political positions, making her a prominent figure in the wider national debate over immigration, refugees and the treatment of minority communities.

The investigation has also drawn attention because the search took place just weeks before the November 3 midterm elections, which will determine control of the US House of Representatives and Senate. Democratic lawmakers have questioned the timing of the operation and raised concerns about whether federal investigative powers are being used to put pressure on political opponents. The Justice Department has traditionally advised prosecutors to avoid overt investigative steps involving political candidates close to elections when those actions could improperly influence the vote. However, the timing of the search alone does not prove that the investigation was politically motivated.

Trump has denied involvement in the search, while the Justice Department has provided limited information about the investigation. The lack of publicly disclosed evidence has left important questions unanswered, including what investigators believe may have been inaccurate in the immigration paperwork, whether Omar is suspected of knowingly submitting false information and whether prosecutors intend to pursue criminal charges.

These distinctions are important because paperwork completed by a parent during a child’s immigration process does not, by itself, establish that the child knowingly committed fraud. Investigators would need evidence of the specific conduct under examination before criminal liability could be determined.

For now, Omar is maintaining that the allegations are politically motivated and has made clear that she will continue her political work despite the investigation. Her declaration that she will not be silenced has become a central part of her response, while her opponents continue to demand answers about her immigration history.

As the investigation proceeds, the case is likely to remain a point of political contention in the United States, bringing together questions about immigration enforcement, accountability for elected officials and the independence of federal law enforcement. However, until authorities disclose the evidence and any legal proceedings establish wrongdoing, the allegations against Omar remain unproven.
